HOME IMPROVEMENT AGREEMENT

Contractor agrees to furnish all labor, materials, equipment, supervision, and services necessary to complete the home improvement work described in this agreement. The work to be performed shall be specifically described in the scope of work attached to or incorporated into this agreement. Any labor, materials, services, or work not specifically included in the scope of work shall be considered additional work and may require a written change order.

The total contract price shall be the amount agreed upon by the parties and may be paid according to the payment schedule set forth in this agreement. Pursuant to California law, the down payment for a home improvement contract may not exceed ten percent (10%) of the contract price or one thousand dollars ($1,000), whichever is less.

Contractor shall commence work on or about the estimated start date and substantially complete the work by the estimated completion date. The parties acknowledge that commencement and completion dates are estimates only and may be extended due to weather conditions, acts of God, labor disputes, material shortages, delays caused by suppliers, governmental actions, unforeseen site conditions, change orders, or other circumstances beyond Contractor's reasonable control.

No changes, additions, alterations, or deviations from the original scope of work shall be performed without a written change order approved by both parties. Any change order may result in an increase or decrease in the contract price and an extension or reduction of the completion time.

Contractor warrants that all work performed under this agreement shall be completed in a good and workmanlike manner and in substantial compliance with applicable building codes and industry standards. Manufacturer warranties on materials, products, and equipment installed under this agreement are separate from Contractor's warranty and shall be assigned to Owner to the extent permitted by the manufacturer.

Contractor shall maintain all licenses, permits, and insurance required by applicable California law, including workers' compensation insurance when required and any applicable general liability insurance coverage.

Mechanic's Lien Warning: Anyone who helps improve your property, but who is not paid, may record what is called a mechanic's lien on your property. A mechanic's lien is a claim, like a mortgage or home equity loan, made against your property and recorded with the county recorder. Even if you pay your contractor in full, subcontractors, laborers, suppliers, or other persons who helped improve your property may record mechanic's liens and sue you in court to foreclose the lien. To preserve their right to record a mechanic's lien, each claimant must provide you with a document called a Preliminary Notice. You can protect yourself against liens by requiring your contractor to provide lien releases from everyone who has provided labor or materials for your project.

Owner acknowledges receipt of a fully completed copy of this agreement and all notices and disclosures required by California law.

Notice of Cancellation: You, the buyer, have the right to cancel this transaction without any penalty or obligation at any time before midnight of the third business day after the date you signed this contract. If you cancel, any property traded in, any payments made under the contract, and any negotiable instrument executed by you will be returned within ten (10) business days following receipt by the contractor of your notice of cancellation. To cancel this transaction, you may mail or deliver a signed and dated written notice of cancellation to the contractor no later than midnight of the third business day after signing this agreement.

This agreement constitutes the entire agreement between the parties. No oral representations, statements, promises, or inducements not contained in this agreement shall be binding. This agreement may be modified only by a written instrument signed by both parties.

Any dispute arising under this agreement shall be governed by the laws of the State of California. The parties agree to attempt in good faith to resolve any disputes arising out of this agreement before initiating litigation. Contractor shall be entitled to payment for all labor, services, materials, and approved change orders furnished under this agreement in accordance with its terms.

Contractor's License Information: Contractors are required by law to be licensed and regulated by the California Contractors State License Board (CSLB). Questions concerning a contractor may be referred to the CSLB. A contractor's license can be checked through the CSLB before signing a contract or authorizing work to begin
